Alan C. Bradshaw was recently quoted in an article in the Westlaw Journal Insurance Coverage in regards to the recent Supreme Court decision in the United States Fidelity & Guarantee Co. v. United States Sports Specialty Association case.

 
He said "This is an important victory for policyholders in Utah and elsewhere. Liability insurance companies often try to "reserve" a right to collect from their policyholders the money they pay in defense costs or to settle. They do so even though most policies do not give them this right and doing so puts them in an adverse position with the policyholders they are paid to protect. This decision makes clear that an insurance company cannot seek to shift the risk to the policyholder when they settle or defend unless they have an express contract right to do so. If an insurance company decides to pay without a contract right, they must do so without attaching a string to the money."

Manning Curtis Successfully Represents Independent Gubernatorial Candidate Farley Anderson in a landmark e-signature case before the Utah Supreme Court.

 

In a June 22, 2010 decision, believed to be the first ruling on this issue in the nation, the Utah Supreme Court ruled that the Lieutenant Governor could not exclude electronic ballot access signatures submitted to him by independent Gubernatorial Candidate Farley Anderson.  Manning Curtis Bradshaw & Bednar successfully argued that Utah statutes and common law require the Lieutenant Governor to accept any mark, electronic or holographic, made by a citizen with the intent to make it his signature.  This decision by the Utah Supreme Court may pave the way for other courts to require acceptance of electronic signatures in connection with candidate petitions and petitions for initiatives or referenda, thereby expanding citizen participation in the electoral process.
