MCBB has successfully resolved insurance coverage for environmental liability, construction defect liability, automobile liability, errors and omissions liability and many other liability and property claims. Representative Engagements

Obtained a reversal of T.H.E. Insurance Company's $1 million coverage denial for claims arising from a snowboarder's death. The insurer, under its policy exclusions for injuries to employees, denied coverage for claims arising from the accidental death of a professional snowboarder. On its motion for partial summary judgment, MCBB offered four separate bases for coverage under the client's auto and CGL policies. The Utah federal court found coverage under every basis asserted by MCBB. The decision makes $1 million in coverage available under the client's auto policy to resolve claims arising from the snowboarder's death.

Obtained a $1.6 million increase in coverage for a property loss claim. The insurer AIG imposed a coverage cap of $1.9 million on the client's claims arising from a major property loss. MCBB persuaded AIG, without litigation, to reverse its lower coverage determination and pay the full value of the client's $3.5 million loss.
